Important Legal Agreement
These Terms of Service constitute a legally binding agreement between you and NetCredit. By using our services, you agree to be bound by these terms. If you do not agree with any part of these terms, you may not use our services.
1. Acceptance of Terms
Welcome to NetCredit. These Terms of Service ("Terms," "Terms of Service," or "Agreement") govern your use of the NetCredit website, mobile applications, and services (collectively, the "Services").
By accessing or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms apply to all visitors, users, and others who access or use the Services.
1.1 Agreement to Terms
Your use of our Services constitutes your acceptance of these Terms. If you do not agree to these Terms, you must immediately cease using our Services.
1.2 Legal Capacity
By agreeing to these Terms, you represent that you have the legal capacity to enter into a binding agreement and that you are not prohibited from using our Services under applicable law.
2. Eligibility Requirements
To use NetCredit Services and apply for a loan or line of credit, you must meet the following requirements:
2.1 Age Requirements
- Be at least 18 years of age (19 in Alabama and Delaware, 21 in Mississippi)
- Have reached the age of majority in your state of residence
2.2 Residency and Citizenship
- Be a U.S. citizen or permanent resident
- Reside in a state where NetCredit is licensed to operate
- Provide a valid physical address (not a P.O. Box)
2.3 Financial Requirements
- Have a verifiable source of regular income
- Possess an active personal checking account that has been open for at least 90 days
- Have a valid email address and working phone number
- Provide a valid Social Security Number
2.4 Additional Restrictions
- Not be in active bankruptcy proceedings
- Not have outstanding debts with NetCredit in default
- Meet any additional state-specific requirements
Automatic Disqualification
Providing false or misleading information in your application will result in immediate denial and may result in legal action. We verify all information provided and conduct fraud prevention checks.
3. Account Registration and Security
3.1 Account Creation
To use certain features of our Services, you must create an account. When creating an account, you agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Maintain the security and confidentiality of your login credentials
- Accept responsibility for all activities that occur under your account
- Immediately notify us of any unauthorized use of your account
3.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials. You agree to:
- Choose a strong, unique password
- Not share your password with others
- Log out of your account when using shared devices
- Notify us immediately if you suspect unauthorized access
3.3 Account Termination by User
You may close your account at any time by contacting customer service. However, you remain responsible for all obligations incurred prior to account closure, including any outstanding loan balances.
4. Use of Services
4.1 License to Use
Subject to these Terms, NetCredit grants you a limited, non-exclusive, non-transferable, revocable license to access and use our Services for personal, non-commercial purposes.
4.2 Permitted Uses
You may use our Services to:
- Apply for Online Loans or lines of credit
- Manage your account and loan information
- Make payments on your loans
- Access financial education resources
- Contact customer service
4.3 Service Availability
We strive to provide continuous access to our Services, but we do not guarantee that the Services will always be available or uninterrupted. We may suspend or terminate Services for maintenance, updates, or other reasons without prior notice.
4.4 Modifications to Services
We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time, with or without notice, and without liability to you.
5. Loan and Line of Credit Terms
5.1 Loan Agreement
If your loan application is approved, you will receive a separate Loan Agreement or Line of Credit Agreement that contains the specific terms of your loan, including:
- Loan amount or credit limit
- Annual Percentage Rate (APR)
- Payment schedule and due dates
- Total amount to be repaid
- Any applicable fees
- Default provisions
5.2 Electronic Signature
By electronically signing your Loan Agreement, you agree that your electronic signature has the same legal effect as a handwritten signature. You consent to conduct business electronically and receive all disclosures and documents electronically.
5.3 Right to Cancel
Depending on your state of residence, you may have the right to cancel your loan within a certain period after signing. Cancellation rights, if applicable, will be specified in your Loan Agreement.
5.4 Credit Reporting
We report your payment history to the three major credit bureaus (Experian, Equifax, and TransUnion). Both positive and negative payment information will be reported and may impact your credit score.
Separate Agreement
These Terms of Service are separate from your Loan Agreement. In the event of any conflict between these Terms and your Loan Agreement, the terms of your Loan Agreement will govern with respect to your specific loan.
6. Payments and Fees
6.1 Payment Obligations
You agree to repay your loan according to the terms specified in your Loan Agreement. Payments are due on the scheduled due dates, and you are responsible for ensuring sufficient funds are available.
6.2 Automatic Payments
By providing your bank account information, you authorize NetCredit to electronically debit your account for scheduled payments. You may cancel automatic payments by contacting us at least three business days before the scheduled payment date.
6.3 Failed Payments
If a scheduled payment fails due to insufficient funds or other reasons:
- We may attempt to process the payment again
- Late payment may be reported to credit bureaus
- You remain responsible for making the payment
- Additional collection efforts may be initiated
6.4 Early Repayment
You may repay your loan in full at any time without prepayment penalties. Early repayment may reduce the total interest you pay. Contact us to obtain your current payoff amount.
6.5 Fees
Current NetCredit loan products do not charge origination fees, late fees, or prepayment penalties. However, your bank may charge fees for NSF (insufficient funds) or other banking-related issues. State-specific fees, if any, will be disclosed in your Loan Agreement.
7. Prohibited Activities
You agree not to engage in any of the following prohibited activities:
7.1 Fraudulent Activity
- Providing false, misleading, or inaccurate information
- Using another person's identity or information
- Creating multiple accounts to evade restrictions
- Attempting to defraud NetCredit or other users
7.2 Misuse of Services
- Using Services for any illegal purpose
- Attempting to gain unauthorized access to our systems
- Interfering with the proper functioning of the Services
- Using automated tools to access the Services (bots, scrapers, etc.)
- Circumventing security features or authentication measures
7.3 Intellectual Property Violations
- Copying, modifying, or distributing our content without permission
- Using our trademarks, logos, or branding without authorization
- Reverse engineering or decompiling our software or systems
7.4 Harassment and Abuse
- Harassing, threatening, or abusing NetCredit staff
- Using offensive or inappropriate language
- Engaging in discriminatory behavior
Consequences of Prohibited Activities
Engaging in prohibited activities may result in immediate account termination, loan acceleration (requiring full immediate payment), legal action, and reporting to law enforcement authorities.
8. Intellectual Property Rights
8.1 NetCredit Property
All content, features, and functionality of the Services, including but not limited to text, graphics, logos, icons, images, software, and design, are the exclusive property of NetCredit or its licensors and are protected by copyright, trademark, and other intellectual property laws.
8.2 Trademarks
NetCredit®, the NetCredit logo, My ScoreSaver™, My RightFit Tool™, ClearCost for Me™, and other marks are trademarks or registered trademarks of Enova International, Inc. You may not use these marks without prior written permission.
8.3 Limited License
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to access and use the Services for your personal use. This license does not include any right to:
- Reproduce, distribute, or create derivative works
- Publicly display or perform any content
- Use our intellectual property for commercial purposes
- Remove or alter any copyright or trademark notices
9. Disclaimers and Limitations of Liability
9.1 "As Is" Basis
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
9.2 No Guarantee of Approval
Checking your eligibility or applying for a loan does not guarantee approval. We reserve the right to deny any application for any lawful reason without providing specific details.
9.3 Third-Party Services
Our Services may contain links to third-party websites or services. We are not responsible for the content, privacy practices, or activities of third parties. Your use of third-party services is at your own risk.
9.4 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NETCREDIT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
9.5 Maximum Liability
IN NO EVENT SHALL NETCREDIT'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT YOU PAID TO NETCREDIT IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
State Law Variations
Some states do not allow the exclusion or limitation of certain warranties or liabilities. In such states, our liability will be limited to the maximum extent permitted by law.
10. Dispute Resolution and Arbitration
10.1 Informal Resolution
Before filing any formal claim, you agree to first contact us to attempt to resolve the dispute informally. Contact our customer service team at (877) 392-2014 or legal@netcredit.com.
10.2 Binding Arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Services shall be settled by binding arbitration in accordance with the rules of the American Arbitration Association (AAA).
10.3 Arbitration Agreement
By accepting these Terms, you agree that:
- Arbitration will be conducted on an individual basis
- Class actions and class arbitrations are waived
- The arbitrator's decision will be final and binding
- You waive the right to a jury trial
10.4 Exceptions
Notwithstanding the arbitration provision, either party may bring a claim in small claims court if it qualifies. Additionally, either party may seek injunctive or other equitable relief in court to prevent infringement of intellectual property rights.
10.5 Opt-Out Right
You have the right to opt out of this arbitration provision by sending written notice to us within 30 days of accepting these Terms. Your notice must include your name, address, and a clear statement that you wish to opt out of arbitration.
10.6 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law principles.
11. Termination
11.1 Termination by NetCredit
We reserve the right to suspend or terminate your access to the Services at any time, with or without cause or notice, including if:
- You violate these Terms
- We suspect fraudulent or illegal activity
- Required by law or legal process
- Your account has been inactive for an extended period
11.2 Effect of Termination
Upon termination:
- Your right to access and use the Services immediately ceases
- You remain liable for all outstanding obligations, including loan payments
- Provisions that by their nature should survive termination will continue in effect
11.3 Survival
The following provisions survive termination: intellectual property rights, disclaimers, limitations of liability, dispute resolution, and any provisions related to outstanding financial obligations.
12. Changes to These Terms
We may modify these Terms at any time. When we make changes, we will:
- Update the "Effective Date" at the top of these Terms
- Post the revised Terms on our website
- Notify you of material changes via email or prominent notice
Your continued use of the Services after changes are posted constitutes your acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Services.
Stay Informed
We encourage you to review these Terms periodically. Material changes will be communicated to you, but it is your responsibility to stay informed of any modifications.
